This Privacy Policy explains how AgileApt Solutions Private Limited ("AgileApt", "we", "us", or "our"), a company having its registered office at B-821, Advant Navis Business Park, Noida - 201305, Uttar Pradesh, India, collects, uses, discloses, and protects personal information that we obtain through our website https://procurengine.ai (the "Website").

This Policy applies only to the Website - including the lead-generation forms, analytics, and cookies described below. It does not apply to personal data that we process on behalf of our customers through our procurement SaaS product ("Product") once a customer has signed up; that processing is governed by a separate Data Processing Agreement / Product Privacy Policy entered into with our customers.

1. Who We Are

AgileApt Solutions Private Limited is the primary data controller for personal data collected through the Website.

AgileApt Solutions Inc., having its registered office at 8 The Green, STE A, Dover, DE 19901, United States, is a wholly owned subsidiary of AgileApt Solutions Private Limited. AgileApt Solutions Inc. is the entity responsible, as a "business" under the California Consumer Privacy Act (CCPA/CPRA), for personal information of California residents collected through the Website, and is the relevant AgileApt entity for US-facing commercial/contracting purposes. References in this Policy to "AgileApt," "we," "us," or "our" mean AgileApt Solutions Private Limited and, where applicable to US visitors as described above, AgileApt Solutions Inc. (together, the "AgileApt Group").

If you are located in the United States, please direct CCPA/CPRA-related requests to the contact in Section 15(ii). All other privacy queries may be directed to the contact in Section 15(i).

2.1 Information You Provide to Us

When you use a "Contact Us," "Request a Demo," "Book a Call," "Download," or similar call-to-action (CTA) form on the Website, we collect:

  • Work Email address
  • Company name
  • Job Title
  • Phone number
  • Country
  • Any message or additional information you choose to submit

We do not knowingly collect financial information, government identifiers, or any special category / sensitive personal data through the Website.

2.2 Information Collected Automatically

When you visit the Website, we and our service providers automatically collect certain information using cookies, pixels, and similar technologies (see our Cookie Policy for details), including:

  • IP address (which may be used to derive an approximate location/country)

We use Google Analytics 4 (GA4) for this purpose. We may run paid advertising campaigns using Google Ads and LinkedIn Ads, which involve additional tracking technologies described in our Cookie Policy.

  • Qualify and route leads within our customer relationship management (CRM) system (Zoho)
  • Understand how visitors use the Website and improve its content and performance
  • Measure and optimise our marketing and paid advertising campaigns (Google Ads, LinkedIn Ads)
  • Communicate with you about our products, updates, and events, where you have consented or where permitted by applicable law
  • Maintain the security and proper functioning of the Website
  • Comply with applicable legal obligations

4. Legal Basis for Processing

Depending on your location, we rely on one or more of the following legal bases:

  • Consent - for example, when you submit a lead-generation form or accept non-essential cookies
  • Legitimate interests - for example, to understand Website usage, secure our systems, and run reasonably expected marketing analytics, balanced against your rights
  • Performance of a contract or pre-contractual steps - where you request information about our Product ahead of a possible engagement

5. How We Share Your Information

We do not sell your personal information for money. We share personal information only with:

  • Service providers acting on our behalf, including Zoho (CRM and lead management) and Cloudflare (website hosting, content delivery, and security)
  • Analytics and advertising partners, including Google (GA4, Google Ads) and LinkedIn (LinkedIn Ads), who may process data as independent controllers/processors for the purposes described in our Cookie Policy
  • Professional advisors (legal, accounting) where necessary
  • Regulators, law enforcement, or courts, where required by applicable law, or to protect our rights, property, or the safety of others
  • A successor entity, in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections

Under the CCPA/CPRA, our use of advertising cookies/pixels with Google Ads and LinkedIn Ads for cross-context behavioural advertising may be considered "sharing." See Section 10.3 for your opt-out rights.

6. International Data Transfers

Our Website is hosted on Cloudflare's global network, and our service providers (Zoho, Google, LinkedIn) operate data centres in multiple countries, including outside India and, where applicable, outside the EEA/UK. Where we transfer personal data internationally, we rely on appropriate safeguards, such as Standard Contractual Clauses (SCCs), the service providers' own certified compliance frameworks, or your consent, as applicable under the GDPR, DPDP Act, and other applicable laws.

7. Data Retention

We retain personal data collected through the Website only for as long as reasonably necessary to fulfil the purposes described in this Policy - typically for the duration of our sales/marketing relationship with you plus a reasonable period thereafter for record-keeping, legal, and audit purposes - after which it is deleted or anonymised, unless a longer retention period is required by law.

We implement reasonable technical and organizational measures - including encryption in transit (TLS/SSL via Cloudflare), access controls, and vendor due diligence - designed to protect personal data against unauthorised access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You have the right to obtain a summary of the personal data we process about you, request correction or erasure, nominate another individual to exercise your rights in the event of death or incapacity, and lodge a grievance with our Grievance Officer (Section 13) or with the Data Protection Board of India.

10.2 If you are in the EEA/UK (GDPR)

You have the right to access, rectify, erase, or restrict processing of your personal data; to data portability; to object to processing (including for direct marketing); to withdraw consent at any time without affecting prior lawful processing; and to lodge a complaint with your local supervisory authority.

10.3 If you are a California resident (CCPA/CPRA)

We do not knowingly sell or share the personal information of minors under 16.
